Pulling a sickie

A recent case in the Employment Appeal Tribunal has held that an employee who ‘pulls a sickie’ is dishonest and in fundamental breach of contract. This is a conduct rather than a capability issue and the employer is entitled to proceed down the disciplinary process (which is almost certain to be quicker than the capability procedure).
