Constructive Dismissal
If an employer is in breach of a fundamental term of a contract of employment, the employee is entitled to leave the employment immediately. Leaving employment in these circumstances is called ‘Constructive Dismissal’.
This usually arises where the employer tries to implement major changes that have a fundamental effect on the employee’s contractual terms such as salary, job description, hours or place of work, and which justifies the employee resigning.
