Transfer of Undertakings

The Transfer of Undertakings (Protection of Employment) Regulations apply when an undertaking or part of an undertaking is transferred from one employer to another.

Where the transfer regulations apply, and an undertaking is transferred, the position of the previous employer and the new employer is affected. The position of the employees is also affected.

There are risks of a claim for an unfair dismissal if an employee is dismissed as a result of the transfer of an undertaking.
